Terms of use

These Terms of use apply to your account with Feed Viewer’s licensor and constitute a binding contract between us.

Effective date of this Terms of use is the day you first download, install or use the software.

Acknowledgement.

You acknowledge and agree that Feed Viewer including it’s Cloud storage (“Application”) may be disrupted any time due to technical issues or obsolescence of your hardware or operating system, and that the performance of the application may degrade over time. Application could be modified or updated, and its features or portions may be discontinued without prior notice.

You are not explicitly allowed to (1) decrypt an encrypted network traffic or publish otherwise captured network traffic of the application; or (2) violate the license of the rights owners of the content displayed in the application.

You are only allowed to subscribe for a web feed which (1) is publicly accessible, and (2) its usage within the application is in accordance with its license (or with copyright within the Berne Convention when the license is not provided).

You expressly understand and agree that neither application publisher, nor any of its licensors, affiliates, or suppliers shall be liable to you for any consequential, indirect, exemplary, special or incidental damages, including any lost data and lost profits which may be incurred by you, however caused and under any theory of liability. This shall include, but not be limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, cost of procurement of substitute goods or services, or other intangible loss.

You acknowledge and agree that your submission of any information is at your own risk, and to the maximum amount permitted by law, publisher hereby disclaims any and all liability to you for any loss or liability relating to such information in any way.

You acknowledge that Terms of use can be amended at any time.

Maintenance and Support.

Application’s licensor does not provide any maintenance or support for the Application.

Warranty.

The Application is provided on an “as is” basis. As such, Application’s licensor disclaims all warranties about the Application to the fullest extent permitted by law.

Product Claims.

Application’s licensor does not make any warranties concerning the Application.

Third Party Intellectual Property Claims.

You acknowledge that obligation to indemnify or defend any third-party claim arising out or relating to the content you set up access to through the Application is your responsibility. You, not Application’s licensor, shall be solely responsible to the investigation, defense, settlement and discharge of any such third-party intellectual property claim.

Data Collection.

You agree that Application may collect, use, store and transmit technical and related information which is subject to Application’s Privacy Policy and you agree that Privacy Policy can be amended at any time.

Export Controls.

The Application is of European Community origin and is provided subject to the EU Export Administration Regulations. Diversion contrary to EU law is prohibited. Without limiting the foregoing, you agree that (1) you are not, and are not acting on behalf of, any person who is a citizen, national, or resident of, or who is controlled by the government of Iran, North Korea, Sudan, or Syria, or any other country to which the EU has prohibited export transactions; (2) you are not, and are not acting on behalf of, any person or entity listed on the EU Treasury Department list of Specially Designated Nationals and Blocked Persons, or the EU Commerce Department Denied Persons List or Entity List; and (3) you will not use the Application for, and will not permit the Application to be used for, any purposes prohibited by law, including, without limitation, for any prohibited development, design, manufacture or production of missiles or nuclear, chemical or biological weapons.

Final Provisions.

This Terms of use and all matters relating to it shall be governed by and construed in accordance with the laws of the Czech Republic. Any action or proceeding arising out of or relating to this Agreement or the Product shall be brought and maintained exclusively by the Czech courts.
